Terms of Use

These Terms of Use ("Terms") govern your use of punchlinecards.com and the cards, features and services offered there (the "Site"). The Site is owned and operated by Punchline Cards, LLC ("Punchline Cards," "we," "us" or "our"). By using the Site, or by checking the box at checkout, you agree to these Terms. If you do not agree, please do not use the Site. Our Privacy Policy, at punchlinecards.com/privacy/, explains how we handle personal information.

1. Who may use the Site

You must be at least 13 years old to use the Site and at least 18 years old (or the age of majority where you live) to make a purchase. The Saucy Section contains adult humor and is only for people 18 and older. By entering it, you confirm that you are at least 18.

2. Our content and your license to use it

The Site and everything on it, including the card text, character names, character artwork, card designs, illustrations, card numbers, the selection and arrangement of the cards, text, graphics, logos and software (the "Content"), are owned by or licensed to Punchline Cards, LLC and are protected by United States and international copyright, trademark and other laws. Punchline Cards™, Punchline™ and our character names and likenesses are trademarks of Punchline Cards, LLC.

When you buy or send a card, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to personalize that card and send it to your recipient through the Site, and your recipient may view, save and share the card for personal, non-commercial purposes. Except for that license, no rights are granted to you, and all rights not expressly granted are reserved.

3. What you may not do

Unless we give you written permission, you may not:

• copy, reproduce, republish, distribute, sell, license or create derivative works from any Content, including card text, characters or artwork, for any commercial purpose;
• print, sell or offer cards, merchandise, social media posts or other products using our Content, characters or brand;
• copy or imitate the Site, its content, card collection or look and feel to create a competing or confusingly similar website, app, store or product, or present our Content as your own;
• use robots, spiders, data-mining tools or other automated means to access, copy, collect or index the Site or its Content, other than general-purpose search engines indexing public pages in line with our robots.txt file;
• remove, alter or obscure any copyright notice, trademark notice, card number or other identifying information on any card or page;
• use our Content or any card to train, fine-tune or build an artificial intelligence or machine-learning model, dataset or similar system;
• use the Site to harass, threaten, defame or impersonate anyone, or to send unlawful, hateful or sexually explicit messages; or
• interfere with the Site's security or operation, or try to get around the age check, payment or any access controls.

4. Your messages

You are responsible for the names, email addresses and personal message you add to a card ("Your Message"), and for having permission to send a card to your recipient. You keep ownership of Your Message. You grant us a non-exclusive, royalty-free license to store, display and deliver Your Message as needed to provide the Site. We may remove or decline to deliver any card that we believe violates these Terms.

5. Purchases, credits and passes

Prices are shown at checkout in U.S. dollars. Payments are processed by our payment processor, Stripe; we do not store your full card number. A single card is delivered once paid. A 5-card pack gives you five card credits for the email address used at purchase. An annual pass allows unlimited cards from that email address for 365 days from purchase. Credits and passes are personal to you and may not be resold or transferred. Because cards are digital and delivered right away, all sales are final, except where the law requires otherwise. If something goes wrong with a delivery, email us and we will make it right.

6. Scheduled delivery and availability

You may schedule a card for later delivery. We work to deliver every card on time but do not guarantee delivery, since email can be delayed or filtered by the recipient's provider. We may change, suspend or stop any part of the Site, and we may remove sent cards from the Site after a reasonable time.

7. Humor and fictional characters

Our cards are humor and satire. The characters are fictional, and any resemblance to real persons, living or dead, is coincidental. References to historical figures, places or third-party products are for comic or descriptive purposes only and do not suggest any sponsorship or endorsement.

8. Copyright complaints

We respect the intellectual property of others. If you believe something on the Site infringes your copyright, email us at help@punchlinecards.com with the information listed in 17 U.S.C. § 512(c)(3), including your contact information, a description of the work, the location of the material on the Site, a statement of your good-faith belief, and a statement under penalty of perjury that your notice is accurate and that you are authorized to act for the owner.

9. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PUNCHLINE CARDS, LLC AND ITS MEMBERS, MANAGERS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50.

11. Indemnity

You agree to defend, indemnify and hold harmless Punchline Cards, LLC from any claims, losses and expenses, including reasonable attorneys' fees, arising from Your Message, your misuse of the Site, or your violation of these Terms or of anyone else's rights.

12. Enforcement

If you violate these Terms, we may suspend or end your access to the Site and may pursue any remedy available by law, including injunctive relief. Because unauthorized copying of our Content would cause us irreparable harm, you agree that we may seek an injunction without posting a bond, to the extent permitted by law.

13. Governing law and venue

These Terms are governed by the laws of the State of Oklahoma and applicable federal law, without regard to conflict-of-law rules. Any dispute relating to the Site or these Terms will be brought only in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to the jurisdiction of those courts. Either party may bring an individual claim in small claims court instead.

14. Changes to these Terms

We may update these Terms from time to time. The updated Terms take effect when posted, and the effective date above will change. If you keep using the Site after an update, you accept the updated Terms. The Terms in effect when you complete a purchase apply to that purchase.

15. Other terms

These Terms are the entire agreement between you and us about the Site. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor.
